Appeal of Jeff DeLisle (Del Co Ltd.) to a Fire Certificate of Occupancy Correction Notice at 1140 WESTERN AVENUE.

Purpose of Appeal: We are filing this appeal for a couple reasons. One being the fact that its never been an issue before, so why is it now? and secondly, the cost. It would be very expensive to pave a parking lot.

Legislative Hearing Staff Comments:  Photo(s) needed for hearing.  Owner was a no show for the last scheduled hearing.  Diagram of site and parking area was provided.  There are a acouple of concerns outstanding which would need to be discussed before a recommendation to grant the appeal would be made.  Key among these is the area covered by gravel and segrgation of garbage containers on the site.  There seems to be at least 16 potential parking spots of a building with 11 units.  There's a question of the stability of class V over partial asphalt, maybe PW can to help us with it.  Also, where is snow going to be plowed on the lot. Finally, can some of the land which has become parking lot over time, due to migration of gravel, be returned to green?

AMENDED 10/7/2015

 

WHEREAS, in the matter of the Appeal of Jeff Delisle (Del Co Ltd.) to a Fire Certificate of Occupancy Correction Notice at 1140 WESTERN AVENUE, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant; and

 

WHEREAS, the Legislative Hearing Officer recommends that the City Council deny grant the appeal come into compliance by repairing the existing asphalt and bituminous surfacing by January 1, 2016; Now, Therefore, Be It

 

RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter.
