Title

Second Making finding on the appealed substantial abatement ordered for 829 THIRD STREET EAST in Council File RLH RR 23-64.  (Amend: nuisance is abated)

AMENDED 11/6/24

 

WHEREAS, the City Council adopted RLH RR 23-64 on March 6, 2024 which granted 180 days to repair the structure, correct all of the deficiencies listed in the Order to Abate Nuisance Building and the Code Compliance Report at 829 Third Street East; and

 

WHEREAS, the Legislative Hearing Officer reviewed this case on September 24, 2024 to determine if the owner and/or responsible party abated the nuisance conditions and found these conditions were not abated, but will recommend continuing the public hearing to November 6, 2024 for completion of rehabilitation; at which time if the rehabilitation is not completed, the recommendation will be that the Council forfeit $2,500 of the $10,000 performance deposit and continue the case to November 20, 2024, at which point if the work is not completed will recommend another $2,500 of the performance deposit be forfeited, and so continuing with the forfeiture every 2 weeks;

 

WHEREAS, the Legislative Hearing officer found these nuisance conditions unabated and recommends listed conditions above; however, an inspection occurred on October 18, 2024 which resulted in the issuance of the Code Compliance Certificate indicating the nuisance has now been abated, now, therefore, be it

 

RESOLVED, that the Saint Paul City Council adopts the finding of the legislative hearing officer that the nuisance condition is not abated and the matter resolved, but continue to November 6, 2024.
