WHEREAS, in the matter of the appeal of David Gitzen to a Re-Inspection Fire Certificate of Occupancy With Deficiencies at 1136 FIFTH STREET EAST, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant; and
WHEREAS, the Legislative Hearing Officer recommends that the City Council grant a 1-inch variance on the openable height of the egress windows in the south bedroom on the second floor and deny the appeal and grant an extension to July 8, 2011 for compliance on the ground cover on all exterior areas to control erosion; Now, Therefore, Be It
RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter.
