Purpose of Appeal: Please note that an eviction action has already been filed against Ms. Duncan based in part on DSI's condemnation notice. Ms. Duncan does not desire to exclude DSI from entering her apartment. However, Ms. Duncan has not been given notice when the inspector was coming and was not medically prepared for visitors when the inspector arrived meaning that her health would have been placed in grave danger by allowing him in. Ms. Duncan states that the unit is in habitable condition and would like to schedule an inspection to demonstrate her apartment's condition.

WHEREAS, in the matter of Appeal of Thomas Mueller - SMRLS representing Selina Duncan to a Correction Notice - Re-Inspection Complaint (Condemnation) at 170 RUTH STREET NORTH #304, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant; and
WHEREAS, the Legislative Hearing Officer recommends that the City Council grant an extension to August 21, 2020 for compliance or the property be vacated; Now, Therefore, Be It
RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter.
