Approving adverse action against the Auto Repair Garage and Second Hand Dealer-Motor Vehicle Parts licenses held by JCDC, Inc., d/b/a Tires & More at 847 White Bear Avenue North.

WHEREAS, the Auto Repair Garage and Second Hand Dealer-Motor Vehicle Parts licenses held by JCDC, Inc. d/b/a Tires & More (License ID #20100003760) for the premises located at 847 White Bear Avenue North in Saint Paul were the subject of a Notice of Intent to Revoke Licenses dated August 18, 2014, stating that during an inspection of the licensed premises conducted on July 14, 2014, a DSI Inspector documented large piles of tires stored outside of the building in violation of license condition #4; and
WHEREAS, upon a re-inspection conducted on July 30, 2014, a DSI Inspector found the office was cleared out and the doors were locked; and
WHEREAS, the Department of Safety and Inspections recently discovered that the Fire Certificate of Occupancy for the building had been revoked as of March 13, 2014; and
WHEREAS, based on this information, the licensing office recommended license revocation per Saint Paul Legislative Code ยง 40.01; and
WHEREAS, licensee did not respond to the Notice of Intent to Revoke Licenses to request a public or administrative hearing; and
WHEREAS, the Notice of Intent to Revoke Licenses stated that if the licensee failed to request a public or administrative hearing by August 28, 2014, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, that Auto Repair Garage and Second Hand Dealer-Motor Vehicle Parts licenses held by JCDC, Inc. d/b/a Tires & More are hereby revoked.
