Fourth Making finding on the appealed substantial abatement ordered for 939 CHARLES AVENUE in Council File RLH RR 24-6.

WHEREAS, the City Council adopted RLH RR 24-6 on March 13, 2024 which granted 180 days to repair the structure, correct all of the deficiencies listed in the Order to Abate Nuisance Building and the Code Compliance Report at 939 Charles Avenue; and
WHEREAS, the Legislative Hearing Officer reviewed this case on September 24, 2024 to determine if the owner and/or responsible party abated the nuisance conditions and found these conditions abated if code compliance certificate is issued by October 16; otherwise, public hearing will be continued to November 6 and $2500 performance deposit will be forfeited. If still not abated, will forfeit the additional $2500 at the November 20, 2024 public hearing; and
WHEREAS, the Code Compliance Certificate was not issued as of November 20, 2024 and therefore the City Council forfeits the entire $5,000 performance deposit; now, therefore, be it
RESOLVED, that the Saint Paul City Council adopts the finding of the legislative hearing officer that the nuisance condition is not abated, but will hold another Legislative Hearing on January 14, 2025 under separate resolution, pending issuance of Code Compliance Certificate; otherwise, continue public hearing to December 3 November 20 6, 2024.
