Second Making finding on the appeal of Mark Puchala II to a nuisance abatement ordered for 2016 FREMONT AVENUE in Council File RLH SAO 26-59.
Body
WHEREAS, the City Council adopted RLH SAO 26-59 on August 5, 2026 which granted an extension to August 11, 2026 to abate the nuisance conditions at 2016 Fremont Avenue; and
WHEREAS, the Legislative Hearing Officer reviewed this case on August 11, 2026 to determine if the owner and/or responsible party abated the nuisance conditions and found these conditions is abated related to brush pile, the nuisance was not abated as relates to the stones/pavers and compost bin. On August 14, 2026, the Legislative Hearing Officer recommends denying the appeal, noting the compost bin is now in compliance and granting further extension to November 2, 2026 for compliance with pavers/stones;
WHEREAS, the City Council adopted RLH SAO 26-74 on August 19, 2026 which denied the appeal related to the compost bin, noting was in compliance;
WHEREAS, the Legislative Hearing Officer reviewed this case on November 3, 2026 to determine if the owner and/or responsible party abated the nuisance conditions related to the pavers/stones and found these conditions [were/were not abated; now, therefore, be it
RESOLVED, that the Saint Paul City Council adopts the finding of the legislative hearing officer that the nuisance condition is [abated and the matter resolved / not abated and therefore authorizes the Department of Safety and Inspections to proceed with this nuisance abatement].
