Appeal of Matthew E. Ballenthin to a Fire Inspection Correction Notice at 1725 MONTANA AVENUE EAST.

Purpose of Appeal: Repairs indicated for the garage. I have plans to tear down and rebuild the garage in the next 12 months. I have started to research contractors and will soon obtain estimates. It is requested that no corrections to the garage be enforced at this time.

Legislative Hearing Staff Comments: Legislative Hearing Officer granted a request by the appellant to schedule this appeal for October 6, 2015 (more than a month away). Because of this accommodation and because it is getting late in the season, staff informed the appellant that the turnaround time to bring the property into compliance will be short if the appeal is denied.

WHEREAS, in the matter of Appeal of Matthew E. Ballenthin to a Fire Inspection Correction Notice at 1725 MONTANA AVENUE EAST, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant; and
WHEREAS, the Legislative Hearing Officer recommends that the City Council grant an extension until November 1, 2016 to bring garage door into compliance, or until it ceases being structurally sound; Now, Therefore, Be It
RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter.
