Approving and authorizing execution of an Amendment No. 2 to the Site Lease Agreement between the Board of Water Commissioners and Sprint Spectrum Realty Company, LP providing for frequency and equipment modifications and additional rent for wireless equipment at the Board's Mississippi River Pumping Station property in the city of Fridley.

WHEREAS, the City of Saint Paul does possess fee simple title to property commonly known as the Board of Water Commissioners' Mississippi River Pumping Station located at 7501 Alden Way NE in the city of Fridley (the "Property"), such possession of title being for benefit of the Board; and
WHEREAS, the Board entered into a Site Lease Agreement ("Lease") with Sprint Spectrum LP, predecessor-in-interest to Sprint Spectrum Realty Company, LP ("Sprint") dated September 19, 1996, which leased space at the Property to Sprint for the operation of wireless communication equipment; and
WHEREAS, the Board and Sprint entered into Amendment No. 1 to Site Lease Agreement dated March 10, 1998 which corrected the legal description of the property and the leased premises; and
WHEREAS, at this time, the Board and Sprint desire to further amend the Lease to provide for equipment and frequency modifications and an increase in annual rent; and
WHEREAS, the Board did adopt Resolution No. 7198 approving an Amendment No. 2 to Site Lease Agreement, which provided for such modifications with all other terms and conditions of the Lease to remain unchanged and in effect; now, therefore, be it
RESOLVED, that Amendment No. 2 to Site Lease Agreement between the Board of Water Commissioners of the City of Saint Paul and Sprint Spectrum Realty Company, LP to provide for frequency and equipment modifications and additional rent for wireless equipment at the Board's Mississippi River Pumping Station property in the city of Fridley is hereby approved and that the proper officers are hereby authorized and directed to executed said Amendm...
