It looks as if the non-compliance determination was filled out incorrectly by the appellant, as the net clear egress opening dimensions were used in place of the glazed area calculation. A rough estimate of glazed area is closer to a minimum of 8 square feet. Therefore, no variance is required. We need to find out if the dimension they're calling glazed area is that. The dimension they use is the "egress net clear opening" from the window specifications. However, the frame size looks like it glazed area should be a much larger figure.
Variance Recommendation
Yes, window 1 - 1.25 square feet glazed area and 1 inch egress opening height; and window 2 - 1 inch egress opening height.

WHEREAS, in the matter of the Appeal of Pollock Construction LLC, on behalf of Susan Stewart Davis, to an Egress Window Non-Compliance Determination at 280 MAPLE STREET; the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant;
WHEREAS, the Legislative Hearing Officer recommends that the City Council grant a variance for window 1 of 1.25 square feet glazed area and 1 inch egress opening height; and grant a variance for window 2 of 1 inch egress opening height; Now, Therefore, Be It
RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter.
