Pertaining to the release of a public water utility easement granted to the Board at 510 White Bear Avenue South in the City of Saint Paul.

WHEREAS, pursuant to a Grant of Easement for Public Water Utility Purposes dated February 5, 1975 and May 30, 1975, made by the Church of Saint Pascal Baylon, and recorded August 27, 1975 as Document No. 614289 in the Office of the County Recorder of Ramsey County, Minnesota (the “Easement”), an easement was dedicated to the Board of Water Commissioners for public water utility purposes over a portion of the real property (the “Property”) legally described as follows:
The North one-half of that portion of Conway Street lying between the East property line of White Bear Avenue and a line parallel to and 201.21 feet East of the East property line of White Bear Avenue.
WHEREAS, the Board no longer requires the Easement for public water utility purposes and desires to vacate and terminate the Easement for the benefit of the Property and all present and future owners thereof, together with their successors and assigns; and
WHEREAS, staff has drafted a Public Water Utility Easement Vacation and Termination; a recordable document that relinquishes the Board’s rights granted by the Easement; now, therefore, be it
RESOLVED, that the Board of Water Commissioners of the City of Saint Paul does hereby approve the Public Water Utility Easement Vacation and Termination, which releases the Board’s rights granted in that certain Grant of Easement for Public Water Utility Purposes dated February 5, 1975 and May 30, 1975 and recorded August 27, 1975 as Document No. 614289, and that the proper officers are hereby authorized to execute said Public Water Utility Easement Vacation and Termination on behalf of the Board, following approval by the assistant city attorney.
