Title

Amending Council File No. RLH RR 24-32 to abate the Making Finding on the appealed Substantial Abatement Ordered for 188 ACKER STREET EAST.

 

Body

WHEREAS, on October 16, Saint Paul City Council adopted Council File No. RLH RR-32 making a finding on whether the nuisance condition ordered abated in RLH RR 24-32 which found that the nuisance condition at 188 Acker Street had not been abated at the 180-day mark of August 15, 2024, per RLH RR 23-62; and

 

WHEREAS, the Legislative Hearing Officer requested on August 28, 2024 that the City Council continue the public hearing to September 25, 2024 in order that the final corrections per the property owner's representative; and

 

WHEREAS, on September 25, 2024, the Legislative Hearing Officer found the nuisance condition remained unabated and recommended the Council continue the matter for 2 weeks to October 9, 2024 at which point if the nuisance was still not abated, $1,000 of the $5,000 performance deposit should be forfeit; and

 

WHEREAS, on October 9, 2024, the Legislative Hearing Officer found the nuisance condition remained unabated and recommended the Council forfeit $1,000 of the $5,000 performance deposit and continue the matter for 1 week to October 16, 2024 at which point if the nuisance was still not abated, an additional $1,000 of the $5,000 performance deposit should be forfeit - for a total of $2,000

 

WHEREAS, on October 16, 2024, the Legislative Hearing Officer found the nuisance condition was still unabated, but late in that day the building permit was approved with corrections and on October 18, 2024, the Code Compliance Certificate was issued; and

 

WHEREAS, the Legislative Hearing Officer reviewed the matter and now recommends that only $1,000 of the $5,000 performance deposit be forfeit, rather than the previously recommended $2,000; Now, Therefore, Be It

 

RESOLVED, that Council File RLH RR 24-32 is amended to forfeit $1,000 of the $5,000 posted.
