Making finding on the appealed substantial abatement ordered for 188 ACKER STREET EAST in Council File RLH RR 23-62.  (Continue public hearing to October 16, 2024)

WHEREAS, the City Council adopted RLH RR 23-62 on February 14, 2024 which granted 180 days to repair the structure, correct all of the deficiencies listed in the Order to Abate Nuisance Building and the Code Compliance Report at 188 Acker Street East; and

 

WHEREAS, the Legislative Hearing Officer reviewed this case on August 13, 2024 to determine if the owner and/or responsible party abated the nuisance conditions and found these conditions are forthcoming unabated, but requested on August 28, 2024 that the City Council continue the public hearing to September 25, 2024 in order that the final corrections be made, as represented by the property owner's representative; and

 

WHEREAS, pending issuance of no code compliance certificate has not been issued as of September 25, 2024; and

 

WHEREAS, the Legislative Hearing Officer recommends that the City Council again continue the public hearing to October 9, 2024 and if a Code Compliance Certificate has not been issued as of this date, $1,000 of the $5,000 performance deposit be forfeit and the matter again continued to October 16, 2024, and if the Code Compliance Certificate has not been issued as of this date, additional performance deposit will be forfeit; and

 

WHEREAS, the Legislative Hearing Officers finds that as of October 16, 2024 no Code Compliance Certificate has been issued and therefore recommends that an additional $1,000 of the $5,000 be forfeited; now, therefore, be it

 

RESOLVED, that the Saint Paul City Council adopts the findings and recommendations of the legislative hearing officer that the nuisance condition is forthcoming unabated and enforcement action is pending and forfeits a total of $2,000 of the $5,000 performance deposit.
