WHEREAS, in the matter of Appeal of Ferdinand Peters for Leonard Anderson to a Notice of Condemnation as Unfit for Human Habitation and Order to Vacate and Correction Notice at 559 MCKNIGHT ROAD SOUTH, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant;
 
WHEREAS, the Legislative Hearing Officer recommends that the City Council:
 
1)      if Saint Paul Regional Water Services (SPRWS) cannot verify water service within the home upon inspection on September 4, 2014 - deny the appeal;
2)      if SPRWS can verify water services within the home upon inspection September 4, 2014, the condemnation/order to vacate order (item 1 in July 28, 2014 orders) will be lifted as there is compliance;
3)      if SPRWS can verify water services within the home September 4, 2014, the other violations listed in the July 28, 2014 orders shall have the following deadlines:
a.      repairs for the eaves and soffits, exterior walls and trim, and the guardrails (items 4, 5, 6 and 7) shall be completed with building inspector approval by September 19, 2014; and
b.      repairs of the roof and chimney (items 2 and 3) shall be completed with building inspector approval by October 3, 2014; Now, Therefore, Be It
 
RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter.
