Making finding on the appealed substantial abatement ordered for 864 MARION STREET in Council File RLH RR 19-29.  (Amend to grant additional 180 days)

WHEREAS, the City Council adopted RLH RR 19-29 on August 26, 2020 granting 180 days to repair the structure, correct all of the deficiencies listed in the Order to Abate Nuisance Building and the Code Compliance Report at 864 Marion Street; and

 

WHEREAS, the Legislative Hearing Officer reviewed this case on February 23, 2021 to determine if the owner and/or responsible party abated the nuisance conditions and found these conditions were not abated and the project was determined to be approximately 20% completed by the 180-day deadline established by the City Council; and

 

WHEREAS, the Legislative Hearing Officer recommends that the current $5,000 performance deposit be continued, rather than forfeited; however, the owener must post an additional $5,000 performance deposit, as well as updated documentation of financial capacity to complete the rehabilitation and a new affidavit setting aside project-specific funds;

 

WHEREAS, the Legislative Hearing Officer recommends that the City Council grant an additional 180-days to complete the rehabilitation since above the conditions are met forthcoming, pending March 9, 2021 hearing; now, therefore, be it

 

RESOLVED, that the Saint Paul City Council adopts the findings and recommendation of the legislative hearing officer that 1) the nuisance condition is forthcoming is not abated; 2) the current $5,000 performance deposit is continued and an additional $5,000 put in place; and 3) grants an additional 180 days to September 8, 2021 for completion of the project.
