Legislative Hearing Staff Comments: Note, an emergency vacate order was issued for the 125 side, lower unit, November 9, 2016 based on inspector observations when he went to re-placard the building with the revised vacate date from the November 8 Legislative Hearing. The November 9 order is appealable, but is not the subject of this appeal. As the situation with the lower side of 125 was determined to be an emergency, the unit may not be re-occupied until the inspector lifts the condemnation or a hearing is conducted and that recommendation results. -MCM

WHEREAS, in the matter of the Appeal of Augustina Bonkat to a Fire Certificate of Occupancy Revocation and Order to Vacate at 123-125 COLORADO STREET EAST, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant; and
WHEREAS, the Legislative Hearing Officer recommends that the City Council grant an extension to December 13, 2016 for the building to be vacated of all occupants; Now, Therefore, Be It
RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter.
