Approving the application for a license approval for Lexington Restaurant Group LLC d/b/a The Lexington for the Liquor On Sale-291 or more seats, Liquor On Sale Sunday, Liquor Outdoor Service Area (Patio) and Entertainment (A), requesting a modification to the existing license conditions, (License ID #20150000044) for the premises located at 1096 Grand Avenue.

Body

 

WHEREAS, on September 11, 2024, the Department of Safety and Inspections (DSI), received a letter from Lexington Restaurant Group LLC requesting the removal of condition #2, #6, #8, and #9 from the liquor license (attached); and

WHEREAS, in response to the notification no objections or comments were received; and

WHEREAS, the Council finds that the application is in order and there are no grounds to deny approval of the license; now, therefore, be it,

RESOLVED, the license application approval for the Liquor On Sale-291 or more seats, Liquor On Sale Sunday, Liquor Outdoor Service Area (Patio) and Entertainment (A) license is hereby approved and issued to Lexington Restaurant Group LLC d/b/a The Lexington (License ID #20150000044), requesting a modification to the existing license conditions, for the premises located at 1096 Grand Ave. with the following license conditions:

License Conditions Requesting to REMOVE:

A.                     Liquor service and consumption is not permitted in any portion of the building unless prior written approval has been obtained from the City Building Official under issuance of a building permit, and a valid Certificate of Occupancy (CofO) has been issued authorizing occupancy of the specific space.

 

B.                     Licensee will retain an acoustic engineer to perform a noise impact analysis and follow all recommendation for mitigation of noise impacts in compliance with state and local rules and regulations.

 

C.                     The Liquor-Outdoor Service Area (Patio) licenses will not be issued until the City approves a building certificate of occupancy for the patio area.

 

D.                     The proposed parking improvements increasing the number of parking spaces will be maintained in compliance with the site plan dated 10/26/16. This includes the placing of bike racks and the employment of parking attendants to park or guide patrons to the parking spaces.

 

 

Existing License Conditions to Remain:

1.                     Per City of Saint Paul Legislative Code 411.02, the definition of Entertainment A is, “Amplified or nonamplified music and/or singing by performers without limitation as to number, and group singing participated in by patrons of the establishment.” (includes karaoke). Entertainment A license does not allow for patron and/or performance dances.

 

 

CONDITIONS #2-5 PERTAIN TO ROOFTOP PATIO:

 

2.                     Sunday through Thursday all food and beverage service, including alcohol service, will stop at 9:30 p.m.; the Patio will close and all patrons will vacate the Patio area by 10:00 p.m.

 

3.                     Friday and Saturday all food and beverage service, including alcohol service, will stop at 11:30 p.m.; the Patio will close and all patrons will vacate the Patio area by 12:00 a.m.

 

4.                     Licensee will offer food service during Patio hours.

 

5.                     Licensee will install signs at its rear entrance reminding patrons that the restaurant is located in a residential area.
