Approving the application with conditions, per the Deputy Legislative Hearing Officer, for Bing Enterprises LLC (License ID # 20200001393), d/b/a The Gnome, to add a Gambling Location license to its existing Liquor On Sale - 101-180 seats, Liquor On Sale-Sunday, Liquor On Sale-2AM Closing, Liquor-Outdoor Service Area (Patio), and Entertainment (B) licenses, located at 498 Selby Avenue.

WHEREAS, Bing Enterprises LLC (License ID # 20200001393), d/b/a The Gnome, located at 498 Selby Avenue, has applied for a Class N license to add Gambling Location license to its existing Liquor On Sale-Sunday, Liquor On Sale-2AM Closing, Liquor-Outdoor Service Area (Patio), and Entertainment (B) licenses; and
WHEREAS, a notification regarding the license application was sent from the Department of Safety and Inspections to the affected neighborhood for the period of April 9, 2021 to May 28, 2021; and
WHEREAS, during the notification period, objections were received which triggered the hearing and a hearing was held on June 7, 2021; and
WHEREAS, the objections were related to noise from rowdy and intoxicated customers, business attracting “undesirable outside elements”, traffic, parking, increase in crime, etc.; and
WHEREAS, one of the individuals who submitted the opposition also testified in opposition to the license at the hearing; and
WHEREAS, in response to the concerns raised, the licensee has agreed to exchange contact information with concerned residents and work with the City to comply with the necessary requirements to minimize nuisance activities that would disturb the surrounding residential neighborhood; and
WHEREAS, after conducting the hearing and considering the testimonies and evidence, the Deputy Legislative Hearing Officer recommends that the application to add a Gambling Location license to its existing Liquor On Sale - 101-180 seats, Liquor On Sale-Sunday, Liquor On Sale-2AM Closing, Liquor-Outdoor Service Area (Patio), and Entertainment (B) licenses, for Bing Enterprises LLC (License ID # 20200001393), d/b/a The Gnome, located at 498 Selby Avenue, be approved with no new conditions added to the existing condition:
1. Licensee shall take appropriate actions to ensure that any noise generated by the activities associated with the operations of the business complies with City of St Paul Legislative Code Chapter 293 Noise Regulations.
THEREFORE, BE IT RESOLVED that the Council of the City of Saint Paul hereby approves this license application with no new conditions added to the existing condition.
The Conditions Affidavit was previously signed on August 7, 2020.
