WHEREAS, Bing Enterprises LLC, d/b/a The Gnome (License ID # 20200001393), located at 498 Selby Avenue, has applied for Class N licenses for Liquor On Sale - 101-180 Seats, Liquor On Sale - Sunday, Liquor On Sale - 2 AM Closing, Liquor Outdoor Service Area (Patio), and Entertainment (B) licenses; and
WHEREAS, per RES 20-911, adopted June 24, 2020, the City Council voted to waive the 45-day notification period and approve The Gnome’s application for Liquor On Sale - 101-180 Seats, Liquor On Sale - Sunday, Liquor On Sale - 2 AM Closing, Liquor Outdoor Service Area (Patio), and Entertainment (B) licenses with no conditions; and
WHEREAS, objections to Liquor On Sale - 101-180 Seats, Liquor On Sale - Sunday, Liquor On Sale - 2 AM Closing, Liquor Outdoor Service Area (Patio), and Entertainment (B) licenses were received within the notification period, and a hearing was held on August 6, 2020; and
WHEREAS, after conducting the hearing and considering the testimony and evidence, the Deputy Legislative Hearing Officer recommends that the application for Bing Enterprises LLC, d/b/a The Gnome (License ID # 20200001393), located at 498 Selby Avenue, be approved as modified with the following condition:
1. Licensee shall take appropriate actions to ensure that any noise generated by the activities associated with the operations of the business complies with City of St. Paul Legislative Code Chapter 293 Noise Regulations.
THEREFORE, BE IT RESOLVED that the Council of the City of Saint Paul hereby approves this license application with the aforementioned agreed-upon condition.
