Authorizing the application and execution of a trail easement for the Fish Hatchery Trail project.
Body
WHEREAS, CF PH 23-137 authorized the Department of Parks and Recreation to accept federal funding and amend the finance and spending plan for reconstruction of Fish Hatchery Trail (“Trail”); and
WHEREAS, alignment of the existing trail traverses contaminated soils in the location of the former Fish Hatchery Dump located on a Minnesota Department of Natural Resources (“DNR”) parcel; and
WHEREAS, the existing trail alignment required a 10-year lease agreement with the DNR; and
WHEREAS, an alternate trail alignment was determined to minimize exposure of contaminated soils; and
WHEREAS, the alternate trail alignment requires an easement of the DNR parcel for the construction and operation of the trail; and
WHEREAS, in order to allow trail development to proceed, the DNR has agreed to allow the Department of Parks and Recreation, in coordination with City Real Estate Office, to apply for an easement across state land; now, therefore, be it
RESOLVED, that the City Council hereby authorizes the appropriate city officials to apply for and execute a trail easement for the construction of Fish Hatchery Trail.
