Appointing the Public Rights Project (PRP) as special counsel for the purpose of providing legal representation to the City of Saint Paul in affirmative litigation to challenge a federal rule related to grants.

SECTION 1
WHEREAS, upon information and belief the Federal Government intends to implement changes to the rules governing federal financial assistance by the Office of Management and Budget; and
WHEREAS, the City receives several federal grants that will likely be impacted by the proposed changes; and
WHEREAS, PRP is engaging with multiple jurisdictions to prevent implementation of that rule; and
WHEREAS, the City believes that the rule is in conflict with federal, state and local law; and
WHEREAS, if the rule goes into effect, City services and operations could greatly be impacted by the potential loss or interruption in funding; and
WHEREAS, because of the potential impact to the City of Saint Paul, the City desires to join the potential litigation; and
WHEREAS, the City seeks representation by PRP to participate in the potential litigation; now, therefore, be it
RESOLVED, that the Council of the City of Saint Paul does hereby appoint, upon request of the City Attorney and for the purpose of providing advice and counsel to the City of Saint Paul in pending litigation, the Public Rights Project under the direction of Katherine Hubbard, Managing Attorney, as special counsel, and now therefore be it
FURTHER RESOLVED, that the compensation to be paid for the services of said special counsel shall be pro bono, and in accordance with Legal Services Agreement between the Public Rights Project and the City of Saint Paul, there will be no hourly rate paid for the legal services provided to the City of Saint Paul and all services will be provided pursuant to the Retainer Agreement attached as Exhibit 1.
