Pertaining to a Water Utility Agreement between D.R. Horton and the Board of Water Commissioners (Board) for providing water system work with the Century Ponds development located in the City of Maplewood.

WHEREAS, the Board of Water Commissioners of the City of Saint Paul continues to implement the strategic plan goal of Stakeholder Understanding and Support; and
WHEREAS, D.R. Horton will construct water infrastructure in the newly dedicated rights-of-way as part of the Century Ponds development and in conformance with the SPRWS Standards for the Installation of Water Mains and Board staff will inspect the work during construction; and
WHEREAS, a Water Utility Agreement has been drafted between the Board and D.R. Horton to manage the execution of installation and maintenance of the public infrastructure for the Century Ponds development; and
WHEREAS, staff has reviewed said agreement and recommends approval; now, therefore, be it
RESOLVED, that the Board does hereby approve the Water Utility Agreement between the Board and D.R. Horton pertaining to the development of Century Ponds. Staff are hereby authorized to finalize the agreement terms which may include additional surety bond language and to execute said Agreement on behalf of the Board, following approval by the assistant city attorney.
