Pertaining to approving a development agreement with the Saint Paul Port Authority concerning the former Hillcrest Golf Course (“The Heights”) property.

WHEREAS, the Board of Water Commissioners of the City of Saint Paul ("Board") has need to establish a development agreement with the Saint Paul Port Authority (“SPPA”) to ensure the construction of drinking water infrastructure is done to Board standards; and
WHEREAS, the agreement will govern the terms and conditions for construction and inspection of water infrastructure within newly dedicated rights-of-way constructed as part of the development project known as The Heights; and
WHEREAS, SPPA is responsible for the costs of inspection/training/collaboration and this agreement also defines such responsibility; now, therefore, be it
RESOLVED, that the agreement between the Board of Water Commissioners of the City of Saint Paul and the Saint Paul Port Authority governing the terms and conditions for construction and inspection of water infrastructure in The Heights, in substantially the form submitted, and that the proper officers of the Board are hereby authorized and directed to execute said agreement on behalf of the Board following approval of the assistant city attorney.
