Not sure why both a non-compliance determination and fire orders are attached. It looks like the windows got called out in fire orders because the opening dimensions were  In both the measurements in question were for an egress opening of 19"Hx23"W.  The non-compliance determination showed dimensions of 36"Hx21" width - so this needs no variance.
 
Variance Recommendation
Yes, 5 inches in egress opening height (as listed in Fire C of O orders.  No hearing necessary.  Let's call appellant right away and indicate window replacement is not necessary.

WHEREAS, in the matter of the Appeal of Michael Sellers to an Egress Window Non-Compliance Determination at 798 LAKE STREET, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant; and
 
WHEREAS, the Legislative Hearing Officer recommends that the City Council grant a 5-inch variance on the openable height of the egress windows in all bedrooms; Now, Therefore, Be It
 
RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter.
