Purpose of Appeal
The egress window is not being used as a bedroom and the area of the window is greater than that required.  The double hung windows were there long before I bought the house and the reas is greater than that required.

Variance Recommendation
Yes.  Basement  - 4 inch variance on egress opening width.  Main floor north bedroom - 2 inches in egress opening height and 1 inch in egress opening width.  Upper floor bedroom - 4 inches in egress opening height.
 
Grant appeal on permit requirement for basement bedroom, unless specific violation is identified in subsequent orders.

WHEREAS, in the matter of the Appeal of Doug Remly to a Fire Certificate of Occupancy Correction Notice at 308 CLARENCE STREET, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant; and
 
WHEREAS, the Legislative Hearing Officer recommends that the City Council grant a 4-inch variance on the openable width of the egress window in the basement bedroom; grant the appeal on the building permit issue for the window installation; grant a 2-inch variance on the openable height and 1-inch variance on the openable width of the egress window in the main floor north bedroom; and grant a 4-inch variance on the openable height of the egress window in the upper floor bedroom; Now, Therefore, Be It
 
RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter.
