Releasing utility easements in the vacated alley on Project for Pride in Living property near Springfield Street and West Seventh Street.

 

Body

WHEREAS, on June 1, 2011 the City Council approved RES PH 11-934 (County Torrens Document No. 2145904) vacating a portion of platted alley southeast of Springfield Street and West Seventh Street; and

 

WHEREAS, a request has been received from the vacation petitioner, Project for Pride in Living, for the release of remaining utility easements within the vacated alley right-of-way, as depicted on Exhibit A and legally described as:

 

     That part of the alley as donated and dedicated in Block 4,

    Rankin's Addition according to the recorded plat thereof situate

    in Ramsey County, Minnesota, which lies northeasterly of

    Springfield Street and which lies southwesterly of the southeasterly

    extension of the northeasterly line of Lot 7, said Block 4

 

; and

 

WHEREAS, the City of Saint Paul, on behalf of the utility companies with easements in the vacated alley, has determined that the utilities subsequently have been removed from the vacated alley so that the remaining easements may now be released; now, therefore be it

 

RESOLVED, that with the accompanying Certificates of Intended Non-Use, filed voluntarily on behalf of CenturyLink, a Louisiana corportation, Comcast, a Pennsylvania corporation, and Northern States Power Company, dba Xcel Energy - Electric Division, and made a part hereof by this reference and filed in the office of the City Clerk, the City, on behalf of said utility companies releases and waives the rights to said utility easements; and be it further

 

RESOLVED, that upon passage of this resolution and the City's receipt of a $300.00 administrative processing fee, the proper city officials are hereby authorized and directed to record a copy of said resolution in the office of the Ramsey County Recorder and/or Registrar of Titles, and that the City Clerk shall maintain on file a copy of the Certificates of Intended Non-Use referenced in this resolution.
