Resolution Authorizing Acquisition of Vacated Park Land at 2270 Blake Avenue from the City of Saint Paul and Conveyance to Sara Billings LLC as a Conduit Transfer, and Approval of Acquisition Agreement, St. Anthony Park District 12

Body
WHEREAS, the Housing and Redevelopment Authority of the City of Saint Paul, Minnesota (“HRA”), has duly adopted and there is now lawfully in effect in the City of Saint Paul, Minnesota, a City Wide Redevelopment Plan providing for the acquisition, clearance and resale of land for redevelopment and the St. Anthony Park District 12 area is a part of this Plan; and

WHEREAS, the City of Saint Paul (“City”) owns park land known as Gordon Square and located at 2270 Blake Avenue which is immediately westerly of and adjacent to residential property at 35 Langford Park owned by Sara Billings LLC (“Owner”) in St. Anthony Park District 12 area; and

WHEREAS, the Owner has requested and obtained support of Saint Paul Parks and Recreation Commission on April 13, 2011 for diversion of the 3,485 square foot Gordon Square parcel (the”Park Property”) for use as greenspace pursuant to Resolution Number 11-04; and

WHEREAS, the City Council has approved by Resolution 11-933 adopted on June1, 2011 and by Resolution 11-1814 adopted on September 21, 2011, the sale of the Park Property to the Owner through conduit transfer by HRA which is allowed under Section 51.01 of the Administrative Code, Disposition of City Property; and

WHEREAS, the City’s Real Estate Division established a disposition value of $6,500.00 for the Park Property; and

WHEREAS, the transfer of the Park Property from the City to the HRA and the subsequent transfer and conveyance from the HRA to the Owner is governed by the terms and conditions of an acquisition agreement by and among the City, HRA and Owner in the form submitted to the HRA Board for consideration and approval (“Acquisition Agreement”); and
