Approving adverse action against all licenses held by AM PM Gas, d/b/a Marathon Market, 719 Payne Avenue.

WHEREAS, adverse action was taken against all licenses held by AM PM Gas d/b/a Marathon Market (License ID #20070001341) for the premises located at 719 Payne Avenue in Saint Paul by Notice of Intent to Suspend Licenses dated October 5, 2011, alleging licensee failed to pay delinquent license and late fees of $1,312.00 and submit a completed Certificate of Compliance Minnesota Workers' Compensation Law form; and
WHEREAS, per Saint Paul Legislative Code ยง310.05 (m) (2), the licensing office also recommended a $500.00 matrix penalty for failure to submit required information in order to maintain the license; and
WHEREAS, on October 19, 2011, a Renewal Invoice was sent to the licensee indicating they now owed $1,403.00 in delinquent license and late fees; and
WHEREAS, the licensee did not respond to either the Notice of Intent to Suspend Licenses or the new Renewal Invoice to pay the delinquent license and late fees and submit the required information or request a hearing; and
WHEREAS, the Notice of Intent to Suspend License stated that if the licensee failed to pay the delinquent license and late fees and submit required information or request a hearing by October 17, 2011, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, that all licenses held by AM PM Gas d/b/a Marathon Market are hereby suspended for failure to pay delinquent license and late fees.
FURTHER RESOLVED, the licensee is ordered to pay a matrix penalty of $500.00 for failure to submit required information. Payment of such penalty shall be made within thirty (30) days of the date of the adoption of this resolution.
