WHEREAS, in the matter of the Appeal of Rebecca Rand to a Fire Certificate of Occupancy Inspection Correction Notice at 131 CRETIN AVENUE NORTH, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant; and
WHEREAS, the Legislative Hearing Officer recommends that the City Council: 1) grant a 5.25 inch variance on the openable height of the egress windows in the south and northwest bedrooms; 2) grant a 5-inch variance on the openable height of the egress window in the northeast bedroom; 3) grant that the property be exempted from the Fire Certificate of Occupancy Program, noting that no smoke detector affidavit needs to be submitted; 4) deny the appeal on fuel burning equipment heat testing; and 5) grant an extension to June 15, 2012 for painting or demolition of the garage; Now, Therefore, Be It
RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter.
