Authorizing the Department of Parks and Recreation and the appropriate City officials to accept and execute a multi-year Legacy Grant from the State of Minnesota for $396,000, and to amend the financing and spending plans of the 2011 Como Campus Grant Fund budget for the estimated 2011 portion of $99,000.

Body
WHEREAS, a Legacy Grant from the State of Minnesota, Office of Grants Management, in the amount of $396,000 has been awarded to the City of Saint Paul, Department of Parks and Recreation, for the operation and maintenance of the Como Zoo and Conservatory; and

WHEREAS, this grant spans the State's 2012-13 biennium, beginning July 1, 2011 and ending June 30, 2013, with Parks and Recreation applying for reimbursement of costs on a quarterly basis; and

WHEREAS, the Legacy Grant contains an indemnification clause whereby the City will hold the State harmless from any claims resulting from the City's performance under the terms of the grant; and

WHEREAS, the City Council finds that acceptance of the indemnification clause will allow the grant to be accepted and will benefit the Como Zoo and Conservatory which in turn is a benefit to the public; and

WHEREAS, Parks and Recreation requests permission to allow the proper City officials to enter and sign this official grant agreement with the State of Minnesota, and to amend the current year budget in accordance with the anticipated 2011 funding available; and

WHEREAS, Parks and Recreation estimates the necessary amendment of the 2011 budget to be a $99,000 increase to both revenue and spending in the Como Campus special fund grant activity; and

WHEREAS, the Mayor, pursuant to section 10.07.1 of the Charter of the City of Saint Paul, does certify that there are available for appropriation funds of $99,000 in excess of those estimated in the 2011 Como Campus Special Fund budget; now, therefore, be it
