WHEREAS, adverse action was taken against all licenses held by Taher Acquisition Corp. d/b/a Signature Dining (License ID #20020002732) for the premises located at 520 Lafayette Road in Saint Paul by Notice of Violation dated October 6, 2011, alleging that during a re-inspection on July 27, 2011, a DSI Inspector cited the licensee for the same Critical-Major Environmental Health Code violation that had not been corrected by the May 20, 2011 deadline; and
WHEREAS, per Saint Paul Legislative Code ยง 301.05 (m) (9), the licensing office recommended a $150.00 matrix penalty and suspension of the licenses until the violation is corrected; and
WHEREAS, the licensee did respond to the Notice of Violation to request a public which was held on November 16, 2011; now, therefore, be it
RESOLVED, that all licenses held by Taher Acquisition Corp. d/b/a Signature Dining are hereby suspended and the licensee is ordered to pay a $150.00 matrix penalty for failure to correct the Critical-Major Environmental violation cited during a re-inspection on July 27, 2011. Payment of such penalty shall be made within thirty (30) days of the date of the adoption of this resolution.
This resolution, and action taken above, is based upon facts contained in the October 6, 2011, Notice of Violation sent to the licensee and the arguments made at the public hearing on November 16, 2011.
