THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:

Section 1

WHEREAS, on July 13, 2011, the Saint Paul City Council passed an Ordinance (Ord 11-55) to enable licensure of private nonprofit colleges; and

WHEREAS, through scrivenor's error and without formal amendment by the Council, one sentence was omitted from Section 3 of that Ordinance, specifically exempting private nonprofit colleges from those subsections of Section 409.06(g) of the Legislative Code which require public hearing and consent from the neighboring community; and

WHEREAS, the Council intended to include this provision;

THEREFORE the Council hereby amends Chapter 409.06 of the Legislative Code to rectify the scrivenor's error in its earlier amendment to Chapter 409.06.

Section 2

Section 409.06 of the Saint Paul Legislative Code is hereby amended to read as follows:

409.06 Licensing requirements.

a) Application. Any person desiring a license to sell intoxicating liquor shall make his verified application in writing upon a form approved by the liquor control commissioner of the state and shall file the same with the inspector. Such application form shall require that the following information be set forth upon the application, and such further information as may be required:

(1) The name and place of residence of the applicant.

(2) The location of the premises upon which the applicant proposes to sell such liquor and an exact description, including the proposed floor plan and seating capacity, of the particular place within the building structure where such sales are proposed.

(3) Whether the applicant has ever been engaged in a similar business and, if so, the location thereof and the date when so engaged. The application shall be signed and verified by the applicant in person ...
