Title
Amending the spending and financing plans for the Ruth Street Bike Lanes project and setting up a new project for work related to the emergency reconstruction of the failing retaining wall at 220 Marshall Avenue.
Body
WHEREAS, the Department of Public Works has entered into an agreement with the property owner of 220 Marshall Avenue to construct a new retaining wall behind the residence in order to avoid failure of an existing retaining wall, and
WHEREAS, the existing retaining wall is located directly on the property line dividing City owned right-of-way and the 220 Marshall Avenue property, and
WHEREAS, there are no records to indicate who originally constructed the wall or who has ownership responsibility of the wall, and
WHEREAS, Public Works has agreed to construct and pay for a new wall in front of the existing wall, and the 220 Marshall Avenue property owner agrees to have the new wall constructed on his property and take over all future ownership and maintenance responsibility of the wall, and
WHEREAS, Public Works proposes to use a project fund balance remaining in another capital project to fund the construction of the new retaining wall behind 220 Marshall Avenue, so
THEREFORE BE IT RESOLVED, by the Council of the City of Saint Paul, upon recommendation of the Mayor and advice of the Long Range Capital Improvement Budget Committee, that $45,000 is available from the Capital Improvement Budgets as heretofore adopted and amended by this Council, be hereby further amended in the Improvement Budgets in the particulars as specified in the attached fiscal analysis.
