Purpose of Appeal
The furnace was not permitted or installed by licensed persons.  Owner nearly killed us.  We need to secure contractor.  The emergency deficiency regarding the furnace unit is completely justified, but I ask that we have more time to secure a licensed contractor to perform the work in a timeframe that is sufficient to meet safety needs and city code.  The unit is not in operation now, nor will it be until repaired and inspected.  Weather conditions will permit non-use of furnace.  Currently an order for protection from owner is being sought as well.

WHEREAS, in the matter of the Appeal of Juliann Morris to a Notice of Condemnation as Unfit for Human Habitation and Order to Vacate at 633 PALACE AVENUE, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant; and
 
WHEREAS, the Legislative Hearing Officer recommends that the City Council deny the appeal and grant an extension to September 30, 2011 to come into compliance.  The property must be vacated Monday, October 3, 2011 if not in compliance; Now, Therefore, Be It
 
RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter.
