Purpose of Appeal
Replacing windows of same size, full frame replacement.  76 windows to be replaced, 21 are in bedrooms and do not meet egress.  Some windows of same size were installed last year in other units, want to match these.  Do not have denial on permit, was issued online mistakenly.  Dave Nelson instructed me to file appeal.

WHEREAS, in the matter of Jason Oberhamer, JWB Construction, on behalf of Carew Properties, to an Egress Window Non-Compliance Determination at 1935 OLD HUDSON ROAD, 1949 OLD HUDSON ROAD, and 365 LUELLA STREET, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant;
 
WHEREAS, the Legislative Hearing Officer recommends that the City Council grant a 2-inch variance on the openable width of two slider replacement egress bedroom windows measuring 40.144 inches high by 18.85 inches wide; Now, Therefore, Be It
 
RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter.
