Approving the request of the Housing and Redevelopment Authority to release drainage and utility easements in Victoria Park development.

Body
WHEREAS, on September 21, 2001 the City Council adopted RES PH 11-1060 vacating portions of Madson Street and Mercer Way in the Victoria Park development to facilitate efforts by the Housing and Redevelopment Authority (HRA) to assemble and convey land to the Nova Classical Academy for construction of a new school; and

WHEREAS, in addition to the vacation of the street right-of-way and release of accompanying utility easements, the HRA has requested the release of drainage and utility easements, as dedicated in the plat of Victoria Park, which easements are located within HRA-owned parcels adjacent to the vacated streets; now, therefore be it

RESOLVED, that with the Certificates of Intended Non-Use, filed voluntarily on behalf of the Department of Public Works for the City of Saint Paul and other public and private utilities, the City for itself and on behalf of said utilities waives the rights to the drainage and utility easements depicted in Exhibit A attached hereto and described as

The southeasterly 5 feet and the northeasterly 5 feet of Lot 2, Block 7, Victoria Park,
according to the recorded plat thereof, Ramsey County, Minnesota
and
The northwesterly 5 feet and the southwesterly 5 feet of Lot 2, Block 6, Victoria Park,
according to the recorded plat there, Ramsey County, Minnesota, which lies
northwesterly of the southeasterly 5 feet thereof
and
The northwesterly 5 feet and the northeasterly 5 feet of Park, Victoria Park,
according to the recorded plat thereof, Ramsey Couny, Minnesota.
