Resolution Approving and Authorizing Acquisition of Park Parcel from City of Saint Paul and Ratification of Earlier HRA Action to Sell Park Parcel to Friends of Nova Classical Academy, District 9
 
Body
WHEREAS, the Housing and Redevelopment Authority of the City of Saint Paul, Minnesota (the "HRA") is a public body corporate and politic established pursuant to the provisions of Minnesota Statutes, Section 469.001, et seq. (the "Act"); and
 
               WHEREAS, the HRA has the power to engage in development or redevelopment activities under Minnesota law and the HRA is authorized to engage in activities relating to (a) housing projects and development, (b) removal and prevention of the spread of conditions of blight or deterioration, (c) bringing substandard buildings and improvements into compliance with public standards, (d) disposition of land for private redevelopment, and (e) improving the tax base and the financial stability of the community, and to engage in the aforementioned activities when these needs cannot be met through reliance solely upon private initiative and which can also be undertaken in targeted neighborhoods; and is authorized to create redevelopment projects as defined in Minn Stat Section 469.002, Subd. 14; and
 
            WHEREAS, by Resolution PH 11-1011 the HRA Board of Commissioners approved the sale to Friends of Nova Classical Academy ("Developer") of several parcels of land in the Victoria Park Addition in Saint Paul ("Land"), and the HRA Board further approved a Development Agreement with the Developer; and   
   
             WHEREAS, a subsequent title search has disclosed that one of the parcels of Land, designated as the "Park" parcel on the plat of Victoria Park Addition is in fact owned by the City of Saint Paul and not the HRA and it is necessary for the HRA to acquire this Park parcel from the City of Saint Paul so it can sell and convey the same to the Developer; and
 
WHEREAS, the City of Saint Paul will consider at its October 5, 2011 meeting a resolution approving the conveyance of the Park parcel to the HRA, and if such approval is given by the City Council, the HRA desires to acquire the Park parcel from the City of Saint Paul and ratify its earlier action to approve the sale of the Park parcel to the Developer; and
 
          NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Housing and Redevelopment Authority of the City of Saint Paul, Minnesota that:
 
      1.      Subject to approval by the City Council, the HRA Board of Commissioners hereby (a) approves the             acquisition of the Park parcel from the City of Saint Paul on terms and conditions which satisfy the             City Charter's provisions for the disposal of City park land; and (b) ratifies the earlier action taken by             the HRA Board of Commissioners in Resolution PH 11-1011 approving the sale of the Park parcel             to the Developer.
 
          2.        The HRA Executive Director, staff and legal counsel for the HRA are further directed and authorized             to take all actions necessary to implement this Resolution. The HRA's Executive Director is                   authorized to execute any documents and instruments in connection with this Resolution.
