WHEREAS, in the matter of the Appeal of Tom Anderson to a Correction Notice at 2179 BENSON AVENUE, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant; and

WHEREAS, the Legislative Hearing Officer recommends that the City Council deny the appeal as it relates to the demolition of the shed giving an extension to November 30, 2011 for its removal, and grant the balance of the appeal on the condition that the garden be expanded to fill a significant portion of the November 30, 2011 to demolish the shed; Now, Therefore, Be It

RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter.
