Purpose of Appeal
Permit to install 2 bedroom windows.  Both are the largest available insert to match existing but do not make egress code for St. Paul.  They do comply with MN Code 310 1-5.

Yes, 3 inches in egress opening height for 21.75 measured opening.  Hearing required for window with 15.75 measured opening.  Appellant submitted new measurement for the 15.75 measured opening and now it's at 16.25.  Grant a 7.75 inch in egress opening.

WHEREAS, in the matter of the Appeal of Harmony Homes Inc., on behalf of Marsha Hartman, to an Egress Window Non-Compliance Determination at 1663 BAYARD AVENUE, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant; and
 
WHEREAS, the Legislative Hearing Officer recommends that the City Council grant a 3-inch variance on the openable height of the double-hung window measuring 21.75 inches openable height and 25.25 inches openable width; and grant a 7.75 inch variance on the openable height of the double-hung window measuring 43.25 inches openable width and 16.25 inches openable height; Now, Therefore, Be It
 
RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter.
