Approving adverse action against all licenses held by Donald L. Coury, d/b/a St. Paul Flatbread at 439 Robert Street South.
 
Body
WHEREAS, adverse action was taken against all licenses held by Donald L. Coury d/b/a St. Paul Flatbread (License ID #20050004212) for the premises located at 439 Robert Street South in Saint Paul by Notice of Violation dated July 26, 2011, alleging the licensee was cited for one (1) Critical-Major Environmental Health Code violation during a re-inspection of the licensed premises on July 7, 2011; and  
 
WHEREAS, pursuant to Saint Paul Legislative Code ยง 310.05 (m) (9), the licensing office recommended a $250.00 matrix penalty and suspension of all licenses if the licensee failed to correct the violation; and  
 
WHEREAS, on July 22, 2011, the City Attorneys Office received an electronic mail from the inspector indicating that he completed a re-inspection on July 21, 2011 and the licensee was now in compliance; and
WHEREAS, the licensee was now in compliance but had now failed to pay the $250.00 matrix penalty; and
 
WHEREAS, the Notice of Violation stated that if the licensee failed to pay the $250.00 matrix penalty by August 4, 2011, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
 
RESOLVED, Donald L. Coury d/b/a St. Paul Flatbread is hereby ordered to pay a $250.00 matrix penalty for the one (1) Critical-Major Environmental Health Code violation cited during a re-inspection of the licensed premises on July 7, 2011.  Payment of such penalty shall be made within thirty (30) days of the date of the adoption of this resolution.
