Approving adverse action against the Solid Waste Hauler & Vehicle license held by William J. Horrigan, d/b/a Horrigan Hauling at 321 Arlington Avenue East.

WHEREAS, adverse action was taken against the Solid Waste Hauler & Vehicle license held by William J. Horrigan d/b/a Horrigan Hauling (License ID #20000005603) for the premises located at 321 Arlington Avenue East in Saint Paul by Notice of Intent to Suspend License dated July 11, 2011, alleging licensee failed to pay delinquent license and late fees of $485.00, submit current certificates of General and Automobile liability insurance, vehicle identification number, Schedule of Charges, an approved truck inspection and a completed Certificate of Compliance Minnesota Workers' Compensation Law form; and
WHEREAS, per Saint Paul Legislative Code ยง310.05 (m) (2), the licensing office also recommended a $500.00 matrix penalty for failure to submit required information in order to maintain the license; and
WHEREAS, on July 27, 2011, the licensee did respond to the Notice of Intent to Suspend License by coming into DSI to pay the delinquent license and late fees and submit the completed Certificate of Compliance Minnesota Workers' Compensation Law form and the Schedule of Charges but then failed to submit the remaining required documents to maintain the license; and
WHEREAS, the Notice of Intent to Suspend License stated that if the licensee failed to submit the required information or request a hearing by July 21, 2011, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, that the Solid Waste Hauler & Vehicle license held by William J. Horrigan d/b/a Horrigan Hauling is hereby suspended and the licensee is ordered to pay a matrix penalty of $500.00 for failure to submit remaining required information in order to maintain the license. Payment of such penalty shall be made within thirty (30) days of the date of the adoption of this resolution
