Ratifying the 2011 Right-of-Way Maintenance Assessment Program.
Body
WHEREAS, The City Council of the City of Saint Paul, pursuant to Chapter 62 of the Administrative Code and following the public hearing held on November 3, 2010, did adopt a Resolution establishing the level of Right-of-Way Maintenance Service to be performed in the City of Saint Paul, and the estimated amount of service charges to be levied against benefited properties, the work to be performed in 2011, and the charges to be collected with the regular taxes in 2012; and
WHEREAS, The Department of Public Works has performed the approved right-of-way maintenance work and submitted its report together with the total cost of right-of-way maintenance; and
WHEREAS, The City Council determined that the City shall pay the sum of the right-of-way maintenance costs and these costs shall be assessed against benefitted properties, and further resolved that a Public Hearing was held in the City Council chambers on October 5, 2011, for the purpose of adopting the service charges against all benefitted properties; and
WHEREAS, The Council of the City of Saint Paul did hold a Public Hearing on October 5, 2011, for this purpose, and, having heard all interested parties, does hereby adopt the following service charges in accordance with Chapter 14 of the City Charter and said Chapter 62 of the Administrative Code, now, therefore, be it
 
RESOLVED, That the Council of the City of Saint Paul does hereby adopt and levy the following service charges as special assessment against benefitted properties:
            Class  1-A         Downtown Streets            
                              All properties (except residential condos)      $16.62 per assessable foot
                             Residential Condominiums            $  3.20 per assessable foot
           Class 1-B            Downtown Streets (Brick)                  
                              All properties (except residential condos)      $20.11 per assessable foot  
                                  Residential Condominiums            $       3.20 per assessable foot
               Class   2            Outlying Commercial and Arterial Street
                             Commercial Property                  $  8.38 per assessable foot       
                               Residential Property                  $  3.41 per assessable foot      
                Class   3            All Residential Streets
                                Commercial Property                  $  6.18 per assessable foot      
                                Residential Property                   $  3.20 per assessable foot      
                Class   4            All Oiled and Paved Alleys           
                                Commercial Property                  $  1.15 per assessable foot

THEREFORE BE IT RESOLVED, That the City Clerk is hereby directed to transmit a certified copy of this Resolution to the Ramsey County Auditor so that the service charges levied herein shall be extended on the property tax lists of the County and collected in 2012 along with current taxes, and said service charges to be payable in a single installment.
