Approving the license agreement with the Port Authority for land use.

WHEREAS, The City of Saint Paul had a need for space in 2010-2011 to store impounded vehicles towed from city streets during snow emergencies; and
WHEREAS, The Port Authority of the City of Saint Paul can license land at the Southport Industrial District on Barge Channel Road ("the premises"), and agreed to do so; and
WHEREAS, the parties inadvertently failed to place the agreement before council for approval, and needs to formalize the agreement and approval.
NOW THEREFORE, BE IT RESOLVED, that the City of Saint Paul is authorized to enter into the attached agreement with the Port Authority of the City of Saint Paul, which includes an indemnification clause, to license the premises beginning November 1, 2010 and continuing until April 30, 2011, for the purpose of storing impounded vehicles towed from city streets during snow emergencies; and
BE IT FURTHER RESOLVED, that the proper City officials be and hereby are authorized to excute such agreement and any amendments, and thereby assume for and on behalf of the City all of the contractual obligations contained therein.
