Accepting the reassignment of County Road 45 (Lilydale Road) from Dakota County to City of Saint Paul jurisdiction.
Body
WHEREAS, the Lilydale Regional Park Master Plan has been approved by the Metropolitan Council on January 13, 2010; and,
WHEREAS, in order to begin implementing the major components of the Master Plan, County Road 45 (Lilydale Road) requires reconstruction/realignment to better complement the new park design and resolve maintenance and safety issues; and,
WHEREAS, Dakota County and City engineers agree that the most efficient way to accomplish this task is to turn back County Road 45 to be under City of Saint Paul jurisdiction; and,
WHEREAS, Minnesota Statute Section 163.11, Subdivisions 5 and 9 authorizes a County Board to revoke County Road status by resolution of the County Board of Commissioners; and,
WHEREAS, the Dakota County Board intends to pass a resolution on that portion of County Road 45 as described in the attached Agreement For Revocation Of County Road 45; and,
WHEREAS, as a result of the revocation of County Road status, the City of Saint Paul will accept jurisdiction and ownership over the former County Road 45;
NOW THEREFORE, BE IT RESOLVED:
The City hereby accepts the transfer of jurisdiction and ownership and all maintenance, repair and reconstruction responsibilities, as well as all traffic control devices currently in place, for the designated road segment; and,
In consideration of the transfer of jurisdiction and ownership of this road segment, Dakota County agrees to pay the City of Saint Paul and the City agrees to accept from the County a one time payment of the sum of $145,000.00 in accordance with the agreement attached as Exhibit A for the purpose of reconstructing Lilydale Road; and,
The City Council hereby authorizes the Agreement for Revocation of County Road 45 to be executed by the appropriate City officials, and authorizes staff to take all further actions necessary to accomplish said transfer.
