Reinstating the $5,000 performance deposit held by the Department of Safety and Inspections under Legislative Code Chapter 33 pertaining to issuance of building permits for dangerous and/or nuisance structures for 640 MINNEHAHA AVENUE WEST.

WHEREAS, the City Council granted 180 days for the rehabilitation or removal of the buildings at 640 Minnehaha Avenue West on May 19, 2011 in Council File #10-530;
WHEREAS, the performance deposit required under Legislative Code Chapter 33 pertaining to issuance of building permits for dangerous and/or nuisance structures forfeited June 28, 2011 for lack of progress;
WHEREAS, the Legislative Hearing Officer reviewed this case July 12, 2011 to determine if there was sufficient reason for the City Council to consider a stay in the enforcement of Council File #10-530;
WHEREAS, the Legislative Hearing Officer found that it was likely that the rehabilitation was substantially complete and two weeks time was likely sufficient for the completion of this rehabilitation; and
WHEREAS, the Legislative Hearing Officer recommends that the $5,000 performance deposit be reinstated until July 26, 2011, at which time the Certificate of Code Compliance shall have been issued, or the matter will be addressed in Legislative Hearing on August 2, 2011; now, therefore, be it
RESOLVED, that the Saint Paul City Council herewith adopts the recommendation of the Legislative Hearing Officer in this matter.
