Please see attached staff report. In summary, the City has informally stayed the enforcement of Council File 09-843, an Order to Remove or Repair the Structures at 445 PAGE STREET EAST, pending the conclusion of litigation and arrangements for financing due to contractor not completing project, but accepting/demanding payment in full. Thus, the owner was left with no funds to complete the project, and the intervention of Leonard, Street and Deinard on her behalf.

WHEREAS, in the matter of Order to Remove or Repair the Structures at 445 PAGE STREET EAST, the Saint Paul Council granted 180 days for the rehabilitation or razing and removal of the building(s) at this property; and
WHEREAS, this work was incomplete at the conclusion of this time period because the contractor walked from the project, prior to its completion, leaving the property owner with no additional funds for the project's completion;
WHEREAS, there has been much work done on behalf of the property owner to make her whole, and complete the rehabilitation of the building(s) at this property;
WHEREAS, all of the conditions which the Council requires be met prior to the grant of time for rehabilitation have been met as of June 15, 2011, namely: 1) property taxes are current; 2) the Code Compliance Inspection has been conducted; 3) the work plan has been reviewed and found acceptable; 4) documentation of sufficient finances to complete the project has been reviewed and found sufficient; and 5) a Power of Attorney has been reviewed and accepted for Juan Torres to act on behalf of the owner, his mother Juaquina Torres; and
WHEREAS, the Legislative Hearing Officer recommends that the enforcement of Council File 09-843 be stayed for a period of one hundred eighty(180) days in order that the owner may complete the ...
