Purpose of Appeal
...the original window gives a unique look to the interior and exterior of the property. The windows are in good condition and operable. The windows opening are large enough for a person to escape from the property. The height difference is only a couple of inches difference to satisfy the minimum requirement of 24 inches of openable height. The width of the windows exceed 20 inches in opening. I would like a variance on the window.
...It is impossible to install a guardrail on the basement stairs. I would like to create a wall to cover up the empty space. If a rail is installed, it will be impossible to move things up and down the stairs. The stair is too narrow for a guardrail.

WHEREAS, in the matter of the appeal of Lou Tran to a Fire Certificate of Occupancy Correction Notice at 1138 COOK AVENUE EAST, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant; and
WHEREAS, the Legislative Hearing Officer recommends that the City Council grant a 2-inch variance on the openable height of the egress window in the south upstairs bedroom, grant a 4-inch variance on the openable height of the egress window in the north upstairs bedroom, grant the appeal on the guardrail if a wall is installed, recommendation forthcoming deny the appeal on the dryer exhaust duct (appellant to submit photos), deny the appeal for Item 2 (repair rotting wood and roof on carport) and grant an extension to August 1, 2011 for compliance under permit; Now, Therefore, Be It
