RESOLVED, that upon execution and delivery of a release in full to the City of Saint Paul, the proper City officers are hereby authorized and directed to pay out of the Tort Liability Fund 09070-511 to Terri Ann Fox-Fitzgerald, as parent and natural guardian of Mitchell Fitzgerald, and her attorney, Jeffrey S. Sieben, the total sum of forty-three thousand five hundred dollars and no cents ($43,500.00) in full and final settlement of civil court file number 19HA-CV-10-4551 for all claims for damages regarding the March 15, 2009, incident where the City's K9, Sarik, bit Mitchell Fitzgerald. This settlement was approved by Dakota County District Judge Michael Sovis and will be subject to approval of a settlement involving a minor pursuant to Minn. R. Gen. P. 145.
