Inspector Essling reported that the assessment for 1758 Dayton Avenue is for snow and ice removal from public sidewalk full width. The Summary Abatement Order was sent January 3, 2011 with a compliance date of January 6, 2011. It was re-checked on January 6, 2011 and found to be in non-compliance. A letter was sent to Parks and the work was done January 10, 2011 at a cost of $160 plus a service charge of $140 for a total of $300. The letter was sent to Bos Investments, Prior Lake and Occupant. There was no returned mail.

Mr. Busschman is appealing because of inadequate notice. Mr. Schroeder noted that during the time of the mailing, some of the other student occupants were home and others were busy working. He also seemed unaware that the sidewalk needed to be shoveled full width.

The video was viewed showing that the City did the work.

Ms. Moermond stated that the sidewalk needs to be shoveled full width and since this is a corner property, both sides of the corner need to be shoveled so that pedestrians can continue to walk straight ahead.

Ms. Moermond will recommend approval of the assessment.
