Approving the request of District Cooling St. Paul, Inc. to amend District Cooling rates.

WHEREAS, District Cooling St. Paul, Inc. filed notice and an official affidavit on September 20, 2010, notifying the City of Saint Paul of a proposed cooling rate change; and
WHEREAS, the cooling rate change became effective October 1, 2010, until approved or denied by the Saint Paul City Council pursuant to Section 11(e) of the Saint Paul Legislative Code, Appendix K - District Cooling Franchise; and
WHEREAS, evidence and recommendations have been presented to the City Council in the form of a City staff report submitted to the City Council on March 30, 2011, in conjunction with a public hearing on this matter; and
WHEREAS, the overall cooling system customer rates as proposed by District Cooling St. Paul, Inc. represent an average overall cost increase of 2.2% over fiscal year 2010's rates, and thus formal approval by City Council Resolution is required;
NOW, THEREFORE BE IT RESOLVED, that the City Council approves the following cooling system customer billing rates increase as proposed by District Cooling St. Paul, Inc.:
1. The cooling demand rate changes from $25.66 to $26.30 per ton per month effective for fiscal year 2011.
2. The cooling energy rate changes from $0.084 to $0.085 per ton hour effective for fiscal year 2011.
3. The overall cooling single rate changes from $0.341 to $0.348 per ton hour effective fiscal year 2011.
